General. THIS AGREEMENT (“AGREEMENT”) COVERS THE TERMS AND CONDITIONS OF YOUR PURCHASE AND USE OF THE PRODUCTS AND SERVICES PROVIDED TO YOU BY MOVIDA COMMUNICATIONS, INC. (“MOVIDA”). BY PURCHASING, ACTIVATING OR USING OUR PRODUCTS OR SERVICES, YOU AGREE TO THESE TERMS AND CONDITIONS.
MOVIDA RESERVES THE RIGHT TO CHANGE THIS AGREEMENT FROM TIME TO TIME WITHOUT PRIOR NOTICE. ANY CHANGES TO THIS AGREEMENT SHALL BE EFFECTIVE WHEN POSTED. Manner of Use. You agree not to use Movida products and services in any illegal, fraudulent or abusive manner as determined by Movida in its sole discretion. Services are provided at our discretion and we may change or cancel services at any time for any reason, including for improper use of our products or services or for any violation of this Agreement.

You agree to solely use the service for general consumer usage.   You will not use the service for telephone-related commercial usage, such as call centers, chat lines, or resale.   You understand that the service is not intended to be used continuously, without breaks, to create the functional equivalent of a dedicated line.  Movida reserves the right to charge additional fees or cancel service to customers that, in the sole judgment of Movida, generate abnormally high call volumes or abnormally long average call lengths in comparison to those of other customers and accounts.  Movida may suspend or terminate your service, without any liability to you and without notice to you, if you breach any portion of this Agreement or we reasonably suspect you are using Movida service in an improper manner as determined by Movida in its sole discretion.  Customers may not change rate plans until their current balance or their current prepaid card has expired.

Services Provided by Movida. You can use your Movida branded phone only on the Movida Wireless Network. (Movida wireless network services are provided on the Sprint Nationwide PCS Network.*) To use your Movida phone on the Movida Wireless Network, you must activate it and maintain a positive balance in your account. You understand and agree that, absent prior written consent of Movida: (i) you may not use your Movida phone with any other service or on any other network; (ii) your Movida phone may not be "unlocked" or "re-flashed" for use on any other service or network and (iii) you may not otherwise alter or remove any of its hardware or software. The Movida service is for personal use only. Your Movida phone may not be purchased by, or resold to, third parties for activation on any other service or network; nor may it be exported or sold for export outside the United States.

Under Movida’s arrangement with Sprint, Movida customers have access to service anywhere on the Sprint Nationwide PCS Network, reaching more than 250 million people.* Please see geographic coverage maps for details. All coverage maps are representations of areas where you may use service and within these areas there are locations with limited or no coverage. Calls may be dropped or blocked from time to time. Actual coverage and quality of service may vary due to circumstances beyond our control, including network limitations, signal strength, interference from buildings and other structures and atmospheric conditions.

Charges and Minimum Account Balance. Your account will be debited when you use the Movida service to make or receive a phone call, to send a text message, to download ringtones, images, games or other content.

You must maintain a balance in your account of at least $0.25 to make or receive calls or to send text messages. If your account balance is less than $0.25, you will not be able to make or receive calls or send text messages even during the nights and weekends period. You may check your account balance by dialing #MAS (#627). If your account balance falls to zero while you are on a call, the call will be disconnected.

Depending upon your geographic area and other terms and conditions that may affect availability, you may choose from among the different rate plans described below: Dime, Max Plus Plan, Penny Plan (Centavo), or Total Plan. Existing Movida customers may continue to use Movida Uno, Movida Si, Movida Max, Movida Unlimited and Movida Plus, but new customers shall be limited to the plans set forth below. Movida may modify or eliminate rate plans or add additional rate plans from time to time without prior notice. You may switch rate plans at any time, but a change fee may apply each time you switch rate plans.

Time Zone. The area code of your Movida phone number determines the applicable time zone for the airtime charges for all Movida rate plans.
Dime Plan. When you use Movida service to make or receive a phone call, your account will be debited. Charges are $0.10 per minute for all domestic U.S. calls made and all calls received. Charges are $0.10 for each text message sent, whether or not the message is received by the intended recipient. Charges are $0.02 for each text message received.   Additional taxes and regulatory fees apply.

Max Plus Plan. Peak airtime charges are $0.20 per minute for all U.S. calls Monday through Friday, from 7:00 am until 8:59 pm (7:00 am until 6:59 pm with $3.00 early nights option). No airtime charges will apply for making or receiving calls that begin after 9:00 pm and end by 6:59 am (7:00 pm and end 6:59 am with $3.00 early nights option). A call that begins Monday through Friday before 9:00 pm and ends at 9:00 pm (7:00 pm with $3.00 early nights option) or later will be charged at the $0.20 per minute rate. A call that begins Monday through Friday before 7:00 am and ends at 7:00 am or later will be charged at the $0.20 per minute rate. Charges are $0.02 for each text message sent, whether or not the message is received by the intended recipient.  Charges are $0.02 for each text message received.   Additional taxes and regulatory fees may apply.

Penny Plan (Centavo). Peak airtime charges are $0.25 per minute for all U.S. calls Monday through Friday, from 7:00 am until 6:59 pm. Off-peak airtime charges are $0.01 for all U.S. calls. A call that begins Monday through Friday before 7:00 pm and ends at 7:00 pm or later will be charged at the $0.25 per minute rate. A call that begins Monday through Friday before 7:00 am and ends at 7:00 am or later will be charged at the $0.25 per minute rate. Charges are $0.02 for each text message sent, whether or not the message is received by the intended recipient.  Charges are $0.02 for each text message received. Additional taxes and regulatory fees apply.
Total Plan.  Peak airtime charges are $0.10 per minute for all U.S. calls Monday through Friday, from 7:00 am until 6:59 pm. Off-peak airtime charges are $0.05 for all U.S. calls. A call that begins Monday through Friday before 7:00 pm and ends at 7:00 pm or later will be charged at the $0.10 per minute rate. A call that begins Monday through Friday before 7:00 am and ends at 7:00 am or later will be charged at the $0.10 per minute rate. Charges are $0.05 for each text message sent, whether or not the message is received by the intended recipient.  Charges are $0.05 for each text message received. Additional taxes and regulatory fees apply.
Movida Unlimited. Peak airtime charges are $0.25 per minute for all U.S. calls Monday through Friday, from 7:00 am until 8:59 pm.  No airtime charges will apply for making or receiving calls that begin after 9:00 pm and end by 6:59 am.  A call that begins Monday through Friday before 9:00 pm and ends at 9:00 pm or later will be charged at the $0.25 per minute rate.  A call that begins Monday through Friday before 7:00 am and ends at 7:00 am or later will be charged at the $0.25 per minute rate.  Charges are $0.10 for each text message sent, whether or not the message is received by the intended recipient.  Charges are $0.02 for each text message received. Additional taxes and regulatory fees apply.
Max Plan.   Peak airtime charges are $0.25 per minute for all U.S. calls Monday through Friday, from 7:00 am until 8:59 pm.  No airtime charges will apply for making or receiving calls that begin after 9:00 pm and end by 6:59 am.  A call that begins Monday through Friday before 9:00 pm and ends at 9:00 pm or later will be charged at the $0.25 per minute rate.  A call that begins Monday through Friday before 7:00 am and ends at 7:00 am or later will be charged at the $0.25 per minute rate.  Charges are $0.02 for each text message sent, whether or not the message is received by the intended recipient.  Charges are $0.02 for each text message received. International Rates. When calling outside the U.S., in addition to the applicable airtime rate, the following international charges will apply (subject to revision or update and availability).
